NORRISTOWN - A judge has determined that a former Methacton music teacher, who served prison time for molesting a girl he taught in Philadelphia and who later was caught with child pornography while on parole, is not a predator.

Montgomery County Judge Richard J. Hodgson ruled that Gregory J. DiFonzo does not meet the criteria under Megan's Law to be declared a sexually violent predator. The ruling means that DiFonzo will not be subject to the most stringent restrictions possible under Megan's Law.

Those who are declared to be sexually violent predators face mandatory counseling. Residents of the communities in which the defendants live are also notified about their whereabouts, under the law's most stringent community notification restrictions.

"I respect the judge's decision," Assistant District Attorney Samantha Cauffman said on Friday.

The state's Sexual Offender Assessment Board previously determined that DiFonzo is not a predator. However, judges must make the final determination when prosecutors proceed to have a defendant declared to be a predator.
